A Mongrel Mob member has been found guilty of kidnapping and raping a woman who said she drugged him with codeine to escape the house where he was holding her captive. The jury returned a majority verdict yesterday on two of three counts Sammy Douglas Winikerei, 49, was on trial for. He was charged with one count of kidnapping and two of rape. The trial started on Monday in the High Court at Rotorua before Justice John Priestley and a jury.
For there to be a majority verdict 11 of the 12 jurors must agree on a verdict and there must be no chance of a unanimous verdict. The jury couldn't reach a verdict on the second count of rape. Winikerei showed no emotion as the verdicts were given. He and the 37-year-old complainant had been friends for about two years, the court heard during the trial. She drove him throughout the North Island as he did not have a licence. On October 17, 2008 when she drove him to a Putaruru home he refused to let her leave, dragging her to the basement by her hair. In the early hours of the next day he raped her on a mattress in the lounge of the house, the court heard.
The jury could not reach a verdict on a third count of rape, alleged to have occurred on October 19, prior to the woman escaping the house and turning up at the local police station to make a complaint. She told the court she drugged his drink with codeine and escaped when he nodded off. Defence lawyer Max Simpkins had submitted the pair had consensual sex and the woman only complained because she had been caught cheating with Winikerei as she was in a relationship with another gang member. Winikerei was remanded in custody for sentencing in the High Court at Auckland on June 25. He will reappear in the High Court at Rotorua on June 10, at which time the Crown will indicate whether it will proceed with a new trial on the charge for which a verdict wasn't reached.
