A 43-year-old Christchurch truck driver has been jailed for four years over charges of sexually violating a girl.
In the Christchurch District Court today Judge Stephen Erber sent Kevin Bruce Wilton, to jail and imposed a two-year minimum non-parole term. The judge praised the girl who was aged 10 and 11 when Wilton abused her over a six-month period.
Crown prosecutor Anne Toohey said the girl had eventually attended a course where she was educated about sex offending, and that led to her telling of it and making it stop. Wilton denied the offending and the case was heard as a jury trial, but the jury convicted him on charges of sexually violating the girl by digital penetration and three charges of indecent assault.
"The victim's evidence was redolent of truth," said the judge at the sentencing today. "I have sat in this court for over 20 years. I have dealt with many similar cases, and it is appropriate to say that this complainant was the most compelling young witness I have heard in those 20 years." He noted the victim impact report showed she was now distrustful of men and the family had moved to another part of the South Island to make a new start."She found giving evidence very difficult and her self-esteem is low. She is a bright girl and with time and the appropriate intervention she may well recover without too much damage."
But he acknowledged this was speculative and the victim impact report might indicate otherwise. Wilton is a married man in ill-health, who needed crutches to get to the dock for today's sentencing. Defence counsel Steve Hembrow said Wilton would find his time in prison difficult because of his ill-health. He accepted that prison was inevitable, but asked that no minimum non-parole period be imposed. The judge said Wilton's injuries were partly caused by self-harm.
He noted that he had been jailed in 1994 for two and a half years for indecent assault and unlawful sexual connection with a girl under 12. He had not taken the Kia Marama rehabilitation programme for sex offenders because he did not accept the offending. The victim was vulnerable at her age, it was clear Wilton had paid for his actions by offering her treats and gifts. He decided that 16 months' jail - the usual term served for a four-year sentence - was not sufficient and imposed the two-year minimum term. "Having regard to your previous convictions, your refusal to acknowledge any guilt puts the public at risk," he told Wilton. "I warn you now, were there to be any further offending you would open yourself to an open-ended sentence of preventive detention."
