Background
NZ Herald story here
From the Manawatu Standard 19th June 2009
The accused was caught in the act of violating 14-year-old schoolgirl.
A man has been sentenced to eight years jail for the "predatory and
unscrupulous" rape of one schoolgirl and indecent assault of another.
Kerry Alexander Wilson, 45, pleaded guilty in March and was sentenced in the
Palmerston North District Court yesterday.
The attack on the 14-year-olds, who were in school uniform, happened in his
room in the apartment above Guv'nors Tavern on June 19, last year.
His co-accused, Patrick Hare Rehu, 29, is defending two charges of rape and for supplying the girls with cannabis on the same night. Wilson, who stood motionless throughout his sentencing, would give evidence against his co- offender at trial, the court heard. In court, one of the complainant's mothers spoke of "picking up the pieces" after the attack. Although the attack was relatively short, the effects on her daughter would last a lifetime. "Your part to play was evil, you are evil. "You are the living dead ... you have no heart, no feeling and no empathy."
Crown prosecutor Shannon Johnston said the gratuitous and despicable crimes against the two young and vulnerable girls were cowardly. Wilson plied the girls with alcohol until they were extremely intoxicated, then persisted in raping one of them even after a witness intervened, she said. Lawyer Steve Winter said when Wilson was sober he understood the impact of his "disgusting and appalling Behaviour" and he was not a man without a conscience. At the time of the incident, Wilson was not in a stable relationship, had only been in Palmerston North for two months and had no skills or qualifications.
He had just obtained a labouring job at a local supermarket, which he was immensely proud of, he said. "If he was not working, he was either drunk or getting drunk. "He is a sad, lonely, isolated man with limited personal resources." He had been drinking in his room alone when the complainants were brought to his room, Mr Winter said. "He has nothing to be proud of, except that when the time came to face his responsibilities, he has done."
Judge Grant Fraser said Wilson was "literally caught in the act of raping one of the complainants" in a more than unscrupulous and predatory way. Pre-sentence reports suggested Wilson expressed a sense of disgust and embarrassment in himself, but he had a tendency to minimise his offending by claiming he was set up. "Their (victims) innocence has gone and you are responsible for all of the consequences. "It is hard for anyone to understand how you could do that." Wilson was given a minimum non-parole period of four years.
From the Manawatu Standard 6th March 2009
A woman who kicked a door in to find three drunk schoolgirls and her sweaty
boyfriend doing up his pants says she was so disgusted and broken-hearted she
attacked him with a metal wrench.
Her boyfriend, Patrick Hare Rehu, 28, is charged with the rape of two 14-year- old schoolgirls at a room in the apartment above Guv'nors Tavern and for supplying them and another young friend with cannabis on June 19, last year. His co-accused, Kerry Alexander Wilson, 44, pleaded guilty to one charge of raping one of the girls and another of indecent assault just before a depositions hearing in the Palmerston North District Court yesterday. He will be sentenced on June 18.
Rehu, who lived at the apartment along from Wilson at the time of the incident, maintains his innocence. Narkita Rueben, 22, told Judge Gregory Ross how she had briefly come home from work about 4pm to find Rehu playing video games and the three girls sitting on the bed. The two had been in a relationship for about five months and lived together in a room at the Rangitikei Hotel Accommodation.
"I thought there was something wrong ... I was not happy but I had to get back to work." When she returned at 7.30pm, Rehu said the girls had gone home and he would go on his bicycle to buy takeaways for dinner. But after waiting nearly an hour, Miss Rueben discovered his bike was still in the building and she heard a female call out Rehu's name from Wilson 's room down the hall.
When she knocked on his door, Wilson opened it slightly then slammed it in her face, she said. "I kicked the door in and the lock popped ... it flew open." Rehu "looked really nervous and was tying up his shorts", while the girls were in varying states of undress around the room, Miss Rueben said. "He was really sweaty and out of breath. I was yelling and screaming at all of them."
The girls were "very intoxicated" - one could hardly stand up with "legs like jelly" - and another tried to climb out the window, she said. She hit Rehu with a 12-inch-long wrench and pushed one of the girls because she was angry, she said. "I felt sick, I felt disgusted and broken-hearted." Rehu told her he "did it to all three of them", was sorry and told her not to say anything to police. Evidence given by the three girls was suppressed. Rehu was committed to trial and remanded in custody until May 5.
