An offender's explanation that on two separate occasions he made a mistake about the identity of an 11-year-old girl when he lay on top of her was a "complete nonsense'', the Nelson District Court heard yesterday. In sentencing Michael Lawrence Williams to nine months in prison on two charges of indecently assaulting a girl under the age of 12, Judge Joanna Maze said the offending went "far beyond a simple error''.

Williams, a 22-year-old Upper Moutere man who admitted the charges in July, was visiting family in Blenheim when twice he sneaked into the home of an 11-year-old girl while she was asleep, the court heard earlier. Police prosecutor Sergeant Graeme Eden said that about midnight on Boxing Day last year Williams was in Blenheim where he was invited back to the home of a woman for "a few drinks'' and spent the night at the home of the 11-year-old girl.

On two subsequent occasions soon after, Williams sneaked into the house and found the young girl sleeping, and he lay on top of her and moved in a manner that simulated intercourse, the court heard yesterday. In the first instance Williams left when the girl escaped his grasp, and on the second occasion Williams lay on top of the duvet covering the girl and began "humping'' her until she woke up and yelled for him to get out of the room. Williams backed out of the room with his head covered in a blanket before going to the lounge, where he masturbated. Williams fled the house after the girl woke her parents.

Lawyer Wayne Jones said Williams' previous history, including indecent acts in public, was "childish behaviour typical of young juvenile males''. Judge Maze said the recent offending was serious, and with respect to Mr Jones, his comments were "unfair to other members of the male gender''. She acknowledged that Williams needed help, but he was a danger to the public,and did not appear to grasp the seriousness of his offending. She also had regard for the vulnerability of the victim and the impact on her.

"It suggests a level of targeting that was very frightening for a child of 11, particularly in her own home when she had gone to bed,'' Judge Maze said. She denied Williams leave to apply for home detention.
