A recidivist sex offender faces the prospect of an endless jail term after a district court judge transferred his case to the High Court.
Judge Joanna Maze yesterday declined jurisdiction to sentence Richard Wainohu, 28, in the district court and remanded him for sentencing in the High Court at Hamilton on February 13, when a sentence of preventive detention would be considered. The Hamilton man had admitted charges of attempted burglary, two of burglary and one of indecent assault. Judge Maze said Wainohu climbed through the window of a townhouse in Hamilton in April.
The female occupant was eating dinner and watching television and "when she saw you she screamed," Judge Maze said. Wainohu put his face to the woman's breasts and she pushed him away, losing her balance. She managed to escape to a neighbour's house.The night before Wainohu had tried to get into an adjoining townhouse but ran off when he realised he had been seen. That woman was too scared to stay there so spent the night with friends.Once she had gone, Wainohu returned, broke into the house and stole doorkeys. Police found the keys under Wainohu's mattress.
Crown prosecutor Shannon-Leigh Litt said Wainohu was a recidivist offender with previous convictions for indecent assault. A psychologist's report said there was a high risk of Wainohu re- offending, she said. Wainohu was unwilling to acknowledge his sexual offending, lacked empathy for his victims and had low motivation to change, she said. Lawyer Doug Hall said just because Wainohu qualified for preventive detention did not mean he should be sentenced in the High Court. Mr Hall said there was still a "slight chance for successful rehabilitative intervention". "Despite the disturbing context of the assaults there was no use of violence," he said.
