Trower had told a probation officer the incident had been planned, but later denied any premeditation. The judge said he would give Trower the benefit of the doubt but, if there was clear planning, his case would have been elevated to High Court jurisdiction with an application for preventive detention likely.

However, if he was to re-offend in that way, that application would be more than likely, Judge Phillips said. He determined Trower to be at high risk of reoffending and, in sentencing, warned him of three- strikes legislation, with attempted sexual violation a qualifying offence under that law. If Trower was to commit another qualifying offence, he would serve any sentence imposed on that charge without parole.
