On the evening of November 15 last year, Tamihana, who was drunk, had a "liaison" with the 13-year-old's older sister at a nearby school but they were interrupted by the girls' mother. Lawyer Peter Coles said the pair had decided to meet up later that night, and Tamihana was invited back to the girl's bedroom. He then climbed through the window of who he thought was the older sister. "He got the wrong room and got the wrong girl," Mr Coles said.
"He was intoxicated at the time. He thought he was in the right room." Tamihana then made his way over the girl's bed and began kissing her and having "simulated sex" with her. "I think it was more fumbling in the dark than anything else," he said. Judge John Clapham said Tamihana must have known it was not the older sister. "There was a seven-year gap between them (Tamihana and the young girl)," he said.
"Seven years is almost half her lifetime. There's a clear imbalance in size, strength and experience of life here. He must've been alerted. She told him she was 13, but there was continuing of body contact." Judge Clapham said the young girl threatened to scream if he didn't leave. "He got off her and went out the way he came. Through the window."
