The Auckland High Court was told that Setu's offending involved kissing the victim and placing his hand on her genitalia. A pre-sentence report said that Setu showed no victim empathy and had blamed the victim for his offending. In sentencing Justice Hugh Williams declined Setu permission to apply for a substitute home detention sentence.
