A man who molested a girl more than 10 years ago has been denied name
suppression because of the wishes of the victim.
Judge Robert Spear refused name suppression yesterday because the victim had said she wanted David William Ruck's name published. Ruck, of Waiheke Island, was yesterday sentenced in Hamilton District Court to 18 months' jail. He was earlier found guilty following a jury trial on one count each of inducing a child to do an indecent act and indecent assault on a child under 6 years old.
Counsel Glen Marshall said his 57-year-old client had led a blameless life apart from this offending, and there was no possibility that he would re- offend. Prosecutor Mark Sturm said a fully custodial sentence was appropriate because the victim had been very young and defenceless. Judge Spear said the offences took place in the early 1980s and the victim had to carry this with her for more than 10 years before she had summoned up the courage to ask for help. Ruck was an intelligent and well-educated, articulate man who was well aware that what he had done was extremely wrong, he said.
