The girl suffered damage to her anus and genitals which the doctors described as very severe and potentially life threatening. She was expected to have emotional problems requiring long-term rehabilitation. The offences happened while Roberts and the girl waited in the car for the girl's mother to return from an appointment. Roberts also admitted striking the child previously and tearing hair from her head. Her buttocks were covered with bruises.

For the Court of Appeal Justice Casey said the pre-sentence reports suggested Roberts showed little remorse for his actions as his main concern appeared to be the prospect of a lengthy jail term. Roberts appealed the sentence on the grounds it was manifestly excessive. The Court of Appeal, however, confirmed the sentence, saying it was more difficult to imagine a worse case of rape or sexual violation considering the girls age, the beating and sexual torture inflicted on her and the fact Roberts was acting as a stepfather towards the girl.
