Sentenced to 6 years 6 months with a 3 year 3 month non parole period in 2002-03
On appeal head sentence upheld but minimum reduced to 2 years 2 months in July 2003
Background
The Dominion Post, August 6th 2003
A WOMAN who woke from a deep, drunken sleep to find she was being raped had no memory of another man raping her earlier the same day. It was only when dna samples were analysed that it was found Terai Tumataiva Natua had also had sex with the woman. Natua, 23, of Henderson, pleaded guilty to the rape charge four days before his trial was due to begin, and he was sentenced to serve at least half of his 6 1/2-year jail term.
He appealed against his sentence but the Court of Appeal sitting in Auckland last week decided the overall term was not too high. However, the court said the circumstances were not "sufficiently serious" for the judge to set a minimum non-parole period greater than the usual one-third.Natua would be considered for parole after serving two years and two months.
