Indecently touching two young girls has landed a recidivist child sex offender back in jail. In the Hamilton District Court yesterday Gary Alan Maber, 40, was sentenced by Judge Merelina Burnett on two charges of indecent assault on a girl under 12 years after he was found guilty by a jury. Maber, a Hamilton beneficiary, had been at a party and stayed the night at a house where the two young girls lived. The girls had fallen asleep in the lounge. The older girl woke up to find Maber rubbing her chest under her top. She then left the room. The younger girl woke as he squeezed her bottom and pulled down her pants. She also left and the girls told their father what had happened.
Crown prosecutor Tini Clark said Maber was a recidivist offender who showed no remorse and there was a high risk of him reoffending. Defence lawyer Sharron Green acknowledged Maber's previous nine- month jail sentence for a 1995 conviction on a similar charge. However, she said Maber had not breached a position of trust; instead he had breached a position of power. Judge Burnett cited pre-sentence reports which said he had low motivation to change and continued to deny the offending. He had touched vulnerable girls while they slept in a place where they would expect to be safe, she said. She sentenced him to 20 months' imprisonment. On release he faces special conditions for six months to target his sexual offending and alcohol abuse issues.
