A 48-YEAR-OLD man convicted of indecent exposure yesterday told the New Plymouth District Court about his habit of "wafting. "It was a subconscious habit where he pulled out the waistband of his shorts to cool off, said Glenn Peter Laban, who pleaded not guilty to showing his penis to a nine-year-old girl at Lepperton on February 6. He was charged with doing an indecent act with intent to offend.
When cross-examined by police prosecutor Detective Sergeant David MacKenzie, Laban said he was probably "wafting" on the day of the incident. This might have explained how the victim saw his penis, said Laban, who had told police he was not wearing underpants and that he often walked around naked. Earlier, the court heard from the victim, who said she visited the property with her family and met Laban for the first time.
While walking through a gate on the property, she said the defendant lifted the hem of his shorts and exposed himself. The girl gave evidence from behind screens. Judge Patrick Toomey said he believed the victim was telling the truth. Defence lawyer Jacinda Rennie said Laban believed he had been set up by people who did not agree with his habit of going nude. Laban was remanded on bail for sentencing on Friday.
