A TEENAGE bully who indecently assaulted a younger boy who displayed feminine behaviour has been sentenced to 12 months' periodic detention. In the High Court at Auckland yesterday, Justice Laurenson said Nathan Wiremu Hutley, now aged 21, was a classic bully who had picked on a smaller boy, a year younger than him, over a period of nearly three years. Hutley was found guilty by a jury last month on a representative charge of indecently assaulting his victim on several occasions between August 1990 and May 1993 at Gisborne.
Crown prosecutor Brendan Horsley said the age of the accused, who was 14 when the offending began, did not automatically justify leniency. He said Hutley continued to deny his guilt. Justice Laurenson said the complainant had displayed feminine behaviour from an early age, resulting in threats and bullying by Hutley and others. The judge said he failed to see any relevance in an affidavit that described the complainant as being gay. A victim impact report that said the victim had become paranoid "spells out a story which is sadly all too common". The judge said Hutley's general demeanour and inane grinning during the trial made him doubt the sincerity of his apology for "teasing" the boy.
