Background
From Hawkes Bay Today story 31st January 2009
A 40-year-old Napier man was yesterday remanded in custody for sentence after a
jury took less than an hour-and-a-half to find him guilty on a charge of
sexually abusing a teenage girl.
In a trial which started before Judge Geoff Rea and a jury of seven women and five men on Thursday, Bruce Martin Hoby denied the offending, which related to early-morning events as the girl slept beside a baby in a house he was visiting for drinks with the adult occupants in December 2007.
Hoby gave evidence in court on Thursday, denying he had any sexual intentions or contact with the girl who slept on a mattress on the floor of a lounge, next to another room where a number of other adults were talking and playing Monopoly after watching Outrageous Fortune on TV.
Hearing the judge's summary when the court resumed yesterday, the jury retired about 10am and returned about 11.15, finding Hoby guilty on a charge of sexually violating the girl by unlawful sexual connection, but acquitting him on a charge of indecent assault. He was remanded to appear in court for sentencing on March 3.
