Background
The High Court in Hamilton was told the victim had resided in what was called a "party house". Herbert formed an association with the victim's cousin. In sentencing Justice Williams said there were no mitigating factors and that the victim was a vulnerable child. The judge noted the maximum penalty for each charge was 14 years because of the law applicable at the time the offences were committed and unfortunately the court could not impose a minimum non-parole period because there was no jurisdiction to do so which meant Herbert would be eligible for parole at just one third of his sentence.
