A man caught by the mother of the girl he was abusing was jailed for 13 months by a Wellington District Court judge yesterday. Mark Gartner, 40, joiner of Upper Hutt, had pleaded guilty to indecent assault. Judge Marion Frater said on June 20 he had been at home with the 10-year-old girl. She was playing video games in her bedroom. He went in and put his hand in her pants.
Moments later the girl's mother came in but was told nothing was happening. Later Gartner had admitted what he had done and that it had been going on for two or three months. Judge Frater said Gartner had recognised his behaviour was unacceptable and got help. Part of the programme he was doing encouraged him to own up to his offending and he turned himself into Upper Hutt police.
She said Gartner had to move from the house where he had a child by the same woman and was now only allowed supervised access. The judge said the victim said it was yucky and she felt embarrassed but had not told anyone because Gartner had told her not to. Judge Frater said Gartner had developed sexual fantasies about the girl and justified what he had done by saying the girl was enjoying it.
