JAILED New Plymouth doctor Hiran Fernando has lost an appeal against his
convictions for indecently assaulting female patients.
Fernando was sent to prison last year for three years and two months, after
being convicted of 26 charges of indecently assaulting 10 patients. The charges
spanned 21 years -- 1981-2002.
At the five-week jury trial in the High Court at New Plymouth last year Fernando had faced 34 charges against 12 women. He was acquitted of eight indecent assault charges and three sexual violation charges. He was also ordered to pay a total of $29,000 in reparation to the complainants. Fernando has now spent just under a year in prison. He appealed against all his convictions, claiming he was the victim of a miscarriage of justice.
That hearing was held in Wellington in July and in a decision released yesterday, the Court of Appeal dismissed Fernando's appeal against all 26 convictions. Fernando's first Parole Board hearing to consider his release is set down for next month.
A home detention hearing, which had been postponed from August, would be held at the same time. Two weeks after he was convicted of sex crimes, the New Zealand Medical Council removed his licence to practise medicine.
