A beneficiary who indecently assaulted a young man and then went on to drive his car at him repeatedly has been sent to jail for a year. David George Edgeworth, 42, appeared for sentence before Judge Patricia Costigan in the Christchurch District Court on charges of assault and indecent assault. Counsel Greg Trainor said the indecent assault was at the lower end of the scale, although there were aggravating factors. Edgeworth was remorseful, could not explain his actions, and made a full confession to police. He had a tragic background and needed counselling for drug and alcohol abuse.
Judge Costigan said that to Edgeworth's credit he had not attempted to minimise the seriousness of the offending. Edgeworth had offered the complainant a ride home after a night out and had made advances. When he tried to escape Edgeworth had assaulted him, then driven his vehicle towards him several times. A victim impact report showed Edgeworth's actions had an adverse affect on the complainant, and a suspended sentence was inappropriate in the circumstances. A deterrent element was called for. The judge also ordered nine months supervision, during which time Edgeworth must have counselling for drug and alcohol abuse.
