A set of handcuffs dangled from the rear vision mirror of Jason Lee Duffield's car the night he tried to kidnap and rape a Nelson woman late last year. A length of rope and balaclava on the car's front seat also signalled premeditation, Crown prosecutor Craig Stevenson told the Nelson District Court yesterday.
Judge David McKegg called Duffield's attack on the 18-year-old woman, and another woman in her 60s who came to her aid, "predatory". Before sentencing Duffield, the judge said there were no mitigating circumstances in his favour. "People are entitled to freedom on the street and freedom from predatory attacks, such as the one you launched that night."
Stevenson said Duffield's attack was premeditated and almost fatal. He said Duffield later told police he thought he might have killed the 62-year-old woman, who came to the teenager's aid, when he king-hit her from behind. In summing up the judge said Duffield sat in his car and watched the teenager walk past him on her way home from work at 9.40pm on November 12 before he ran up behind her and hit her on the back of the head, knocking her to the ground. "She started struggling and screaming and you put her in a choke hold and dragged her 20m to your vehicle and pushed her into the rear seat," he said. At that point a couple in their 60s came out of their house and saw the struggle.
The husband returned to the house to call the police while his wife approached the car to intercede, said the judge. While Duffield spoke to the woman the teenager managed to escape and ran into the couple's home. The woman turned to follow but Duffield king-hit her from behind with such force she was knocked unconscious, said the judge.
Duffield lost his keys in the struggle and fled on foot, but returned after police arrived and was arrested. He later pleaded guilty to assault with intent to commit sexual violation, intent to injure and kidnapping. Duffield was sentenced to four years and five months imprisonment. He has been held in custody since the attacks.
