A Kauwerau man who received bail conditions including not to associate with children under the age of 16 appeared in the Whakatane District Court last week after his concerns for the safety of children he knew got the better of him. Christopher David Davis, 39, told his probation officer that on February 5 he saw two young children he knew walking down to the river while he was working. Lawyer Johnathan Kay said Davis knew the girls' father and he usually accompanied them to the river, so he called out saying "don't go down there without your father" because he was concerned for their safety.
However as he told the probation officer this, a breach of bail charge was then laid on Davis. Judge Louis Bidois told Davis he couldn't afford to put himself in a position where he or other members of the community were at risk. "You need to understand and appreciate these conditions are there, they need to be complied with," Judge Bidois said. Davis was convicted and discharged with a final warning. "You break those conditions again, you'll be back to jail".
