A babysitter who duped a 12-year-old girl into submitting to an indecent act on the ruse that it was "a Chinese massage'" was yesterday sent to jail for three years by a Christchurch District Court judge.

Aaron Howard Clark, 24, admitted a charge of sexual violation after the incident in October last year, and unrelated drug dealing charges for selling morphine sulphate tablets, cannabis oil, and temgesics to an undercover policeman in January. He also admitted producing cannabis oil. Mervyn Glue, defending, said Clark had no previous convictions but had become involved in abusing alcohol and hard drugs. Since his second arrest, he has sought help to overcome his addictions.

"`Thirteen months ago when the violation charge was committed, he was affected by alcohol and narcotics. He has expressed his regret to me for the distress he has caused this young girl.'" Judge Graeme Noble said the sexual violation charge was the most serious because Clark had grossly abused his position of trust and succeeded in abusing the girl "by a deception referring to Chinese massage or something like that'".

I have read the victim impact report -- she shows all the usual signs of the sexually abused child. Specifically she experiences flashbacks to the abuse and, as is almost always apparent, has a high degree of watchfulness in relation to males. With assistance she is recovering. Your resort to trickery and duplicity is an aggravating feature. Mitigating features include your age, you are a first offender, your plea of guilty, your remorse, and the fact that you desisted when she clearly showed resistance.'"

Clark was sentenced to two years jail for the sexual violation and a cumulative 12-month sentence for the group of offences described by the judge as Clark's activities as a "small-time drug dealer".
