Indecencies against three young children known to him brought an overall term of five years jail for a man sentenced in the Dunedin District Court yesterday. Edward John Balmer (45), caregiver, had admitted five charges laid representatively and two other charges.
The representative charges were inducing a girl aged under 12 to do an indecent act with or upon him, and indecently assaulting the girl, between January 1985 and March 1992, and doing an indecent act with intent to insult or offend the girl between January 1985 and December 1992; inducing a boy under 12 to do an indecent act upon him between June 1990 and June 1994, and doing an indecent act with intent to insult or offend the boy between January 1988 and December 1995.
The two other charges were indecently assaulting the boy under 12 on a date unknown but between June 1990 and June 1994, and doing an indecent act with intent to insult or offend another male complainant on a date unknown but between January 1988 and January 1992. Crown counsel Robin Bates argued for an overall prison term of five years.
However, defence counsel John Westgate was of the view Balmer could be dealt with by a four-year term. Balmer was remorseful, pleaded guilty and was a first offender, Mr Westgate said. The offending stopped 10 years ago and Balmer was of limited intellectual ability. Judge John Macdonald said the offending was repeated and lasted for 10 years or so.
It had a deep impact on the victims. Were it not for the guilty pleas, a prison term of seven to eight years would have been appropriate. For inducing the young girl to do an indecent act with or upon him, Balmer was sentenced to five years prison. For inducing the boy under 12 to do an indecent act upon him, the sentence was four years jail. The other charges resulted in 12-month prison terms. All sentences are to be concurrent.
