A sex offender living in Carterton since his release from prison last year had begun grooming adolescent boys in defiance of a court order that he be supervised for 10 years.
Frederick Bailey, 52, who pleaded guilty to six charges of breaching an extended supervision order, was jailed for 22 months by Judge Susan Thomas in Wellington District Court yesterday.
Bailey, who had eight previous convictions for sex attacks on boys, was given the extended supervision order by a High Court judge last October. He was released into the community in November, to live with relatives in Wairarapa.
He had been jailed for indecently assaulting a 13-year-old boy whom he had contacted about doing odd-job work at his home. He had been given preventive detention, but the Court of Appeal overturned the sentence in 2003 and ordered him to serve three years of a five-year sentence.
The supervision order allowed the Corrections Department to monitor Bailey's movements and had three conditions for him: not to associate with anyone under 16 without an adult present, not to consume alcohol or drugs, and to do training or hold a job only with prior approval.
Judge Thomas said that within two days of being released Bailey had called a 16-year-old and invited him to his home, knowing the boy would bring his 13-year-old brother. He had a talk with them on the side of the road. He also invited a 15-year-old boy to his home, gave him cannabis and watched pornography with him, then invited the boy to sleep in his bed.
She said Bailey had been on bail for one of the six new offences at the time he committed the others. Judge Thomas said it was deliberate and calculated, and Bailey showed signs of grooming at least one of the boys. He was not constrained or inhibited by the court's order and had limited ability to control his sexual impulses.
Other background
Dr Jane Freeman, a clinical psychologist considers him to be a high risk of reoffending. Bailey's recidivism assessment by Dr Freeman notes his; previous treatment failure, poor previous response to conditional release, limited insight, considerable substance abuse history and self-admitted further offending. The Parole Board sensibly kept him in Prison until his Sentence End Date.
