Judge Philip Cooper expressed surprise in the Rotorua District Court in May 1998 at a jury's decision to clear Awa of one rape charge to which he had pleaded not guilty. Awa had pleaded guilty to another charge of having sex with a 12 year old girl. The complainant and her sister had been at Awa's house while her parents were out at a social function.
The court was told that Awa had asked the girl how old she was and she had lied that she was 15. She said she was allowed alcohol and was given some vodka. Awa took her to a sleepout and though his brother banged on the door and tried to get them out, he couldn't. They were interrupted by the girl's father who found his daughter so drunk she was semi-concious and vomiting. A medical examnination revealed the girl had been forcefully penetrated.
Awa had earlier convictions for attempted sexual violation and two for indecent assault. The judge said Awa had also become aroused when he came across a 12 year old girl in a house he had burgled in November 1996. The girl's parents told reporters they were horrified by the light sentence and their daughter would be "haunted for life".
