In December 1996 in the Hastings District court Atkins pleaded guilty to a charge of assault with intent to commit rape, and aggravated burglary related to the same attack. The court heard Atkins had climbed through a window into a woman's home at 1:30 am. The 25 year old victim was asleep, as were her four children. Atkins went into her bedroom, climbed on top of her and tried to hold her down. When she fell off the bed she grabbed the knife that Atkins had dropped and he fled. The attack occurred not long after Atkins had finished serving another jail term for sexual offending and Justice Gallen was told Atkins was at serious risk of reoffending if he was allowed back into the community.
