A Te Anau farmhand was jailed for seven and a-half years for a rape the crown described as both brutal and premeditated when he appeared before Judge Phil Moran in the Invercargill District Court yesterday. Bruce James Anderson, 38, had earlier admitted both raping and indecently assaulting his victim at Te Anau on November 30.
Judge Moran said Anderson had no real understanding of what he had done, and as such posed a significant danger to the community. Counsel Nic Soper said Anderson was an illiterate who had difficulties communicating and had a primeval need for sex which he believed other people shared. Anderson had honestly believed that if he asked the woman for a sexual relationship she would acquiesce.
Crown prosecutor Russell Ibbotson said the attack had been premeditated and brutal with Anderson showing no concern whether his victim lived or died. Judge Moran said the victim had gone to Anderson's home to collect belongings for his estranged wife. "She came by appointment not expecting to find anybody home. You, in the meantime, had taken time off work to be there to meet her. The purpose of you remaining behind was to have sex with her, not only to gratify your own sexual desires but also to hit back at your wife."
Following a violent struggle Anderson raped the woman, lying on top of her with his arm across her chest and neck, obstructing her breathing. "She asked if you were trying to strangle her and if you wanted to be put away for murder. You replied, 'might as well, it was not going to make any difference'."Following the rape the woman used her hands to smear semen on the walls as evidence of the attack. On two unrelated charges of possessing firearms without a licence on the same date, Anderson was convicted and discharged.
