A man who beat a woman into unconsciousness and then had sex with her, during which she woke up screaming, was yesterday sentenced to nine years jail by a Christchurch District Court judge. Te Whetu Te Wharetotara Amai, 33, maintains his innocence on charges of rape and assault despite being found guilty by a district court jury last month, the court heard.
Judge Michael Green told Amai that he could find no mitigating features for the attack in the early hours of April 14, which occurred at his home after he and the woman returned from a birthday party.
''It was quite plain to you that she didn't want to have sex with you and in the course of a struggle you rendered her unconscious with a blow or blows to her head. ''When she regained consciousness, she found you had already penetrated her. This has to be said to be a serious case of rape and there are no mitigating circumstances that I can see at all.
''You have previous convictions for violence, although none for sexual offences. Your behaviour on this night was really a continuation of your attitude to life and other people's rights.'' Amai was sentenced to nine years jail for rape and a concurrent 12-month jail term for assault. He was sentenced to a further two-month jail term for driving with excess breath alcohol, which he admitted.
