AN ASHBURTON man has been jailed for ten-and-a-half years for rape and assaulting a female. Patrick Albert, 44, appeared for sentence in the Timaru District Court yesterday before Judge Brian Callaghan, on charges of sexual violation by rape, and assaulting a female. The complainant, who knew Albert, had acquiesced to intercourse out of fear for what he might do to her children. Albert, his face covered, gained access to her house by kicking down two doors in the early hours of the morning. He told the woman he wanted to talk to her. She put herself between him and her children, who were terrified and screaming.
Albert told her to go into her room, where he threatened to kill himself with a knife. She pulled away when he tried to kiss her. Albert had intercourse with the woman, and bit her neck. When she tried to pull away he sank his teeth in. Judge Callaghan said it did not seem likely the premeditated intent at the time was that Albert wanted to rape the woman; however he obviously intended to enter the premises to accost her. Judge Callaghan said the pre- sentence report talked about an absence of remorse but, as a result of submissions from defence counsel Quentin Hix, he believed Albert now had a sense of shame. "In the cold hard light of the day you now had a sense of shame for what you have done; that's probably as close to saying you have remorse."
