A Rotorua woman has lost an appeal against her conviction for murder.
Kohi Sophie Winkleman, 22, a beneficiary, was refused legal aid to have a lawyer argue her appeal.
The Court of Appeal at Wellington yesterday said no written submissions or other material was received from Winkleman so it considered the only stated ground for the appeal, that the judge made mistakes in summing up the case to the jury.
The court said it was satisfied Winkleman had a fair trial and was properly convicted.
Winkleman also appealed the life imprisonment term she received, but the court said that was the sentence the law demanded and it couldn't be successfully appealed. Winkleman was found guilty of murdering Bobby Raki Ihaia, 24, on July 21, 2000, after an argument about the use of a stereo. Both had been drinking and Winkleman had also smoked cannabis and sniffed a crushed Retalin tablet. Evidence was given that Mr Ihaia had punched and kicked her, and she broke an empty gin bottle over his head. When he left with some of her compact discs she chased him and stabbed him in the chest with a large kitchen knife.
