THE Court of Appeal has rejected a convicted rapist's claim that dna evidence against him was inconclusive and that he should not have been convicted and sentenced to nine years' jail.
Giving the court's decision, Justice Thomas said a dna expert gave evidence that "strongly supported" the charge that Leon Raymond Tuhimata punched, indecently assaulted and raped a woman he attacked in a Napier street on February 25, 1993. He also rejected Tuhimata's complaint that the victim's claim that her assailant had infected her with a venereal disease was not disclosed to the defence."The prosecution had not been aware of this either," Justice Thomas said.
