Leonard Rongo Timo raped a teenager in his bed while an 11-year- old lay nearby. Yesterday in the Hamilton District Court the 62-year-old Hamilton sickness beneficiary was sentenced to eight years' six months' jail after a jury found him guilty of rape.
The rape occurred on December 28, 2003, after the victim, 17, had been drinking at a party at his house. She fell asleep in a bedroom where an 11-year-old was also sleeping, and later woke to find Timo having sex with her. Twenty minutes later he came into the room again and began rubbing her hips, but the child woke and told him to go away.
Judge Neil MacLean said the attack was a gross violation of trust of a vulnerable young woman. Defence lawyer Gordon Wilson said Timo was embarrassed and ashamed. The attack had devastating effects on his family. During his trial Timo maintained it was a case of opportunistic sexual activity. Crown prosecutor Jacinda Foster said the rape had a devastating effect on the victim. "The prisoner abused her trust and chose to rape her while she was sleeping, vulnerable and unable to protect herself," she said.
