Background
The Court of Appeal was told the complainant was partying with friends including Tiatia and had drunk a considerable amount of alcohol over the evening. The complainant gave evidence that when she and the others arrived at her friend's house at around 3 AM she was fairly sober. She and Tiatia both stayed overnight at her friend's place. At about 4.15 AM Tiatia approached her while sleeping. She was raped and badly hurt. The complainant vomited as a result of what happened to her.
