A drug dealer described as a "one-stop shop" for various drugs continued to blatantly offend even when granted bail, a court has been told.
In the High Court in Christchurch, Justice France told Scott Andrew Swarbrick, 27, that his abundant offending on bail was a seriously aggravating factor. He jailed Swarbrick for 7 years, with a minimum term of 3 years.
He ordered that Swarbrick's utility vehicle be forfeited, along with $16,832 cash found when police searched his Christchurch premises. Swarbrick admitted multiple counts of supplying methamphetamine and receiving stolen property, and also possessing methamphetamine for supply, supplying LSD, possessing cannabis and psilocybine for supply, possessing a shotgun and ammunition, and possessing drug- related utensils.
Many of the charges arose while Swarbrick was on bail for similar offending in April and May. The judge said that in October, police picked up extensive evidence of regular drug-dealing using telephone intercepts, Swarbrick also making significant sales of methamphetamine to an undercover officer.
The Crown described Swarbrick's activities as a "one-stop shop" for various drugs, the intercepts revealing about 150 calls a day on his cellphone. Police also found thousands of dollars of stolen property and, in a lock-up rented by Swarbrick, a 12-gauge shotgun and ammunition, plus 150 rounds of . 22 ammunition.
The judge said Swarbrick was an addict and a twice-daily smoker of methamphetamine. "It emphasises the ongoing misery this drug causes, not only on users, but on days like this, to family and friends," he said. Aggravating factors justified a starting point of 10 years and a minimum term, the judge said.
Lawyer David Ruth said a probation report was bleak, but Swarbrick was not beyond redemption and in time would be able to mend his ways. He was dealing, at least in part, to support his own addiction. Prosecutor David Jackson said the main issue for the Crown was the question of a minimum term, otherwise there was a risk Swarbrick's time in jail would not be long enough to mend his ways.
There was also an issue of community protection, he said. The judge said Swarbrick was the father of a five-year-old and had a relationship and supportive family. He was a qualified butcher, but also a long- term user of cannabis and methamphetamine.
