A man hid behind the door of the woman’s nightclub toilet so he could rape a woman in the cubicle, the Auckland District Court was told yesterday. Lawrence John Smith, aged 25, a beneficiary, or Herne Bay, pleaded guilty to a charge of raping a 31-year-old woman at the nightclub early last Sunday morning.

Smith went to Stanley’s Nightclub at 11pm on Saturday from a Ponsonby hotel, where he had been drinking since 3.30 pm. Police said Smith became disconsolate after unsuccessful attempts at making conversation with women, so he decided to rape someone. Smith sat at a booth opposite the woman’s toilet and made two unsuccessful attempts to approach women who went into the toilet alone.

He decided to hide behind the toilet door when he saw a woman towards the toilet by herself, police said. As the woman came in, Smith grabbed her from behind and put his hand over her mouth. He told her not scream and dragged her to the far cubicle. Smith locked the door before ripping off the woman’s clothes. He punched the woman in the mouth and told her to keep quiet or he would kill her. Smith then raped the woman and his attack continued for about 15 minutes.

After some time, several patrons banged on the cubicle door. The woman screamed and, after the toilet door was forced, she managed to escape. Defence counsel Mr Roger Chambers said he was concerned about Smith’s stability after after a suicide attempt last week. He requested that prison authorities keep "a close eye" on Smith

One can only wonder why, given this serial sex deviant's "very bad record when it came to sexual offending" and his very high risk to public safety, had not already been given preventive detention. Surely this predator will never reform and would it not simpler to just throw away the key?
