Background
From a Christchurch Press story
A man was sentenced to two years in prison with leave to apply for home detention after pleading guilty yesterday to a sexual relationship with a 14-year old girl. Christchurch District Court heard how Stuart Alan Sincock, 28, would pick the girl up on her way to school and take her to his home for sex before dropping her back to continue her lessons. Although he knew his actions were illegal, Sincock had not considered they were immoral because of the consensual nature of the relationship, defence counsel Nick Rout said.
When the girl broke off the relationship Sincock went her house to try to make up with her. She got him to leave but he returned and smashed a door panel to get in, forcing her into an embrace and putting his hand under her skirt. On two more occasions she struggled free and he left but returned again to steal items of her clothing which were later found by police at his house. The sentencing judge said he would take into account Sincock's guilty plea, balanced against earlier offences of assault against a woman who was the mother of his child.
The judge described Sincock's behaviour as "controlling". An aggravating factor was the age disparity. Laws had been made to protect young women because they were not mature emotionally to cope with adult relationships and especially because an older man had relatively more power over a young woman. Probation reports suggested that Sincock was not sympathetic to the victim and was remorseful more because of his own situation. The starting point for a prison term was two and a half years but the judge said he reduced it to two years in the interests of rehabilitation, with the benefit of family support, and Sincock was given leave to apply for home detention.
