Sentence Commencement and Sentence Length
Head Sentence
Means the full sentence of imprisonment the court has imposed, an offender may serve some of it or all of the sentence.
Cumulative term
Means an offender is sentenced for two or more crimes being served before or after the other.
Concurrent term
Means an offender is sentenced for two or more crimes being served at the same time as the other - effectively the sentences are served in parallel.
Non parole period
Means an offender is required to serve a minimum period of imprisonment imposed by the court before he/she is eligible to be considered for conditional early release to serve the remainder of his/her head sentence in the community.
Pre-cd Sentence
Means a sentence of more than 12 months commencing before July 2002 (imposed under the Criminal Justice Act 1985).
Post-cd Sentence
Means a sentence of more than two years commencing after July 2002 (imposed under the Sentencing Act 2002).
Custodial and Non-Custodial Sentences
What is a Custodial Sentence?
When an offender is to serve out his/her sentence in prison, an educational institution, reformatory or other correctional facility. If a convicted offender is diagnosed with a mental illness they may under the Criminal Procedure (Mentally Impaired Persons) Act 2003 be detained as a special patient under the Mental Health (Compulsory Assessment and Treatment) Act 1992 to serve out his/her sentence there.
What is a Non-Custodial Sentence?
When an offender is to serve out his/her sentence in the community. This includes community work, community detention, home detention, fines, counselling and taking courses and compulsory treatment, restriction orders, intensive supervision, or even suspended sentences. If an offender is found to be in breach of a non-custodial sentence this may result in the sentence being rescinded by the court to be replaced with a custodial sentence.
Preventive Detention and Life Imprisonment
What is Life Imprisonment?
A life sentence in New Zealand means a head sentence of life with a non-parole period of no less than ten years. Under new laws passed in May 2010 are no longer required to set a non-parole period when a life sentence is to be imposed. Judges now have the discretion to impose a life sentence without parole for the worst cases of murder and under the new "three strikes" legislation for serious violent offenders and sex offenders a sentencing just must impose a life sentence without parole if murder is a second strike offence unless it would be manifestly unjust. The mandatory sentence in New Zealand for any murder is life imprisonment unless it is a mercy killing see R v Law (2002) 19 CRNZ 500 (HC), or where there is evidence of prolonged and severe abuse of the defendant or their children the court will be able to consider a lesser sentence e.g. a 5 year or 10 year finite sentence.
What is Preventive Detention?
A sentence of preventive detention in New Zealand is effectively a head sentence of life imprisonment with a non-parole period of no less than five years. The sentence of preventive detention differs from life imprisonment in that its main purpose is protection of the community from further offending as opposed to being punitive. It is a sentence only available to serious violent offenders and sex offenders.
NZ's longest non parole periods (18 years or more)
The offenders listed here are those sentenced life imprisonment or preventive detention (pre-cd sentences or post-cd sentences). They are serving the longest minimum non-parole periods in New Zealand's history. Most of these offenders have been sentenced for cases of murder. They are in order by which was the longest minimum non-parole period imposed by the court.

However in March 2010 the Court of Appeal set new starting points for 4 different bands of rape.

Aggravating and Mitigating Factors in Sentencing
Aggravating Factors
Aggravating factors include:
- Actual or threatened violence, or the actual or threatened use of a weapon, or unlawful entry into, or presence in, a dwelling place.
- If the offence was committed while the offender was on bail or still subject to a sentence.
- The absence/lack of remorse shown by the offender; the extent of any loss, damage, or harm resulting from the offence.
- If there was particular cruelty in the commission of the offence.
- If the offender was abusing a position of trust or authority in relation to the victim.
- If the victim was particularly vulnerable because of their age, health or other factors known to the offender.
- If the offender committed the offence partly, or wholly, because of hostility towards a group of persons who have an enduring common characteristic such as race, colour, nationality, religion, gender, sexual orientation, age or disability, if the offender committed the offence partly, or wholly, because of hostility towards a group of persons who have an enduring common characteristic such as race, colour, nationality, religion, gender, sexual orientation, age or disability, and the hostility is because of the common characteristic, and the offender believes that the victim has that characteristic.
- Premeditation on the part of the offender and the level of premeditation involved, and the number, seriousness, date, relevance, and nature of any previous convictions of the offender, and any convictions for which the offender is being dealt with at the same time.
Mitigating Factors
The mitigating factors that may be taken into account include:
- The age of the offender.
- If and when the offender pleads guilty.
- The conduct of the victim.
- Whether the offender had limited involvement in the offence.
- Whether the offender has diminished intellectual capacity.
- Any evidence of the offender's previous good character.
- Any remorse shown by the offender, or any offer, agreement, response or measure to make amends.
Note: Being affected by the voluntary consumption or use of alcohol or other drugs is not to be considered a mitigating factor.
