A man convicted of a burglary and then the home invasion-style rape of a woman in the same house two nights later, has lost an appeal against his 12-year jail sentence. Raymond Selwyn pleaded guilty to burglary and sexual violation by rape. He was sentenced to one year in prison for the burglary and 11 years for the rape, to be served cumulatively. During the night of September 23, last year, Selwyn broke in to a house and stole a television and food. Two days later at 3.30am, he broke in through a window, and sexually violated then raped a 51-year-old woman who was asleep in her bedroom.
Selwyn had 114 previous convictions, but none for sexual crimes. The Court of Appeal rejected defence submissions that the sentencing judge gave insufficient credit for the guilty plea and gave aggravating features too much weight. The aggravating features included premeditation, additional violence used on the victim, and previous convictions. The appeal was dismissed.
