Background
Hawkes Bay Today story February 3rd 2007
A woman was yesterday sentenced to eight years and three months in jail for what a judge described as a "shocking" home invasion and stabbing of a sleeping 53-year-old woman in Napier. Josephine Pineaha, 43, broke into the victim's Taradale Road home early on the morning of August 8 last year and stabbed the victim repeatedly in the face and torso, while the victim's 91-year-old disabled father was asleep in another room.
Stealing from the victim's home as she left, Pineaha was apprehended later in the day and after spending four months in custody last month, pleaded guilty to a charge of wounding with intent to cause grievous bodily harm and aggravated burglary. Yesterday in the High Court in Napier, Justice Ronald Young sentenced her to eight years and three months for the wounding, and ordered a minimum non-parole period of four years. On the burglary charge, Pineaha was sentenced to a concurrent term of three years.
The judge noted she had 10 previous convictions for violence, and considered Crown prosecutor Jo Rielly's contention that a starting point for the sentence should be 10-12 years, and defence counsel Steve Manning's proposition it should be 9-10 years. The judge settled on 11, and gave Pineaha a credit of two years and nine months for pleading guilty and avoiding protracted proceedings.
