Background
From a NZ Herald on Sunday story November 21st 2004
"A Taurnaga man with 33 convictions for deviant sexual behaviour may spend less than five years behind bars despite fears that he is highly likely to reoffend...... In the High Court at rotorua on Friday, Justice McKenzie turned down preventive detention, saying it was too harsh because Toko Pearson was only 20 and had a tragic upbringing.
From the Financial Times 2004
The man had stalked 24-year-old Angela, grabbed her as she entered a Tauranga public toilet, then smashed her repeatedly in the face before she managed to escape. Toko Pearson, 20, had been paroled for just four days when he committed the vicious attack the night of July 16th
Toko Pearson terrorised two women just four days after he was released from jail on parole for previous sexual crimes. Experts say he is highly likely to break the law again. But despite their fears, a judge has decided to give him another chance. In the High Court at Rotorua yesterday, Justice McKenzie turned down a request for Pearson to be sentenced to preventive detention
