Background
Timaru Herald story here
A Timaru man who waited in a woman's bed all night before assaulting and raping her when she returned home in the morning, yesterday pleaded guilty to all charges laid against him in the Timaru District Court. Shaun David O'Sullivan, 27, pleaded guilty to charges of male assaults female, threatening to kill, injuring with intent to injure, injuring with intent to cause grievous bodily harm, indecent assault, sexual violation by unlawful sexual connection and sexual violation by rape. The incidents occurred in October 2008. O'Sullivan was committed for trial in January this year but yesterday pleaded guilty to seven amended charges.
The police summary of facts stated that O'Sullivan had been at a party the previous night with the victim. Both had consumed a moderate amount of alcohol during the evening and taken a drug. At the end of the night they had an argument and the victim left the party with another person. O'Sullivan then went to the garage of her house and took an axe from the garage. He let himself into the house, placed the axe under her bed, and climbed into the bed fully clothed. He then lay there for several hours waiting for her to come home. The victim arrived the next morning and was unable to get into the house as O'Sullivan had locked the doors.
She had to climb in the window and as she did so O'Sullivan jumped out from the bed. They discussed what had happened the night before and the victim said she had had sex with another man. O'Sullivan became enraged, slapping her across the face and head-butting her. He then grabbed her by the throat, and pinned her down, forcing her head into a pillow so that she was unable to breath. He verbally abused her and threatened to kill her. The attack then continued with O'Sullivan ripping the victim's clothing off below the waist and pulling her outside, half naked, by the hair.
He dragged her back into the house shortly after, where he sexually assaulted and raped her. The attack lasted between 20 and 30 minutes. After the offender had left the house the victim got into her car and drove to the Timaru police station. When O'Sullivan was located that day by police he admitted most of the violence involved in the incident and the indecent assault. He denied raping or sexually violating the victim. He said he had become enraged because she spent the night with another man. O'Sullivan was convicted and remanded in custody for a probation report and sentence on May 27.
Timaru Herald story from 23rd January 2009
A Timaru man allegedly held a woman hostage at her home and raped her, Timaru District Court was told yesterday. Shaun David O'Sullivan, 27, was committed for trial on charges of sexual violation by unlawful sexual connection, sexual violation, indecent assault, trespass, unlawfully detaining a person, aggravated
attempted burglary, injuring with intent to injure (two charges) and threatening to kill. At a depositions hearing defence lawyer Sarah Saunderson-Warner conceded
there was a prima facie case to answer.
Judge Raoul Neave remanded O'Sullivan on bail until April 9 for trial in the High Court. In her evidence, the complainant said she and the defendant had been at a party the night before, but had left separately. When she returned to her home the next morning, the defendant was hiding in her bed. They talked and she admitted having sex with another man the previous night. The defendant then became upset, and struck her across the face, ranting at her and saying he was going to kill her.
He head butted her in the face, grabbed her around the throat with both hands and began to strangle her. She told the court that he ripped her clothing off below the waist, and forced her outside half naked, before dragging her back into the house, and then touching her genitals and having sex with her. The attack lasted 20 to 25 minutes. An axe was found under her bed, which she said was kept in the garage. She said she had never taken it into the house.
