Background
In the Auckland High Court, Justice Rodney Hansen set starting point of 13 years but uplifted it to 15 years to reflet Ngawhika's earlier offending but reduced this by a third due to his early guilty plea. The judge turned down the Crown's application for preventive detention.
The 24 year old victim was residing with her mother in Sunnyhills, Pakuranga. The victim had returned from overseas soon before the attack. Ngawhika burst into the victim's home at night while her mother was out, disabled the telephones and turned off the power. He entered the victim's room, battered her, attacked her with a kitchen knife, raped her, performed oral sex on her, penetrated her digitally and fondling her. The attack lasted for about an hour. Ngawhika had been observing the victim's moves for some time prior to the attack.
