A man jailed yesterday for 10 years for sex offences vowed to get the person who yelled from the back of the court that the sentence should have been longer. Rodney David McNichol, 41, made a noisy exit from the dock in the High Court at Wellington.
Justice Gendall heard McNichol didn't accept the jury's verdicts finding him guilty of abduction, sexual violation by rape, two counts of indecent assault and four of sexual violation by unlawful sexual connection.
Jail terms totalling 10 years were imposed. The judge said McNichol had violated a 10-year-old girl with a plastic penis-shaped object, raped and sodomised her. She was injured and contracted sexually transmitted diseases. Prosecutor Mark O'Donoghue said the girl needed cervical smears annually for the rest of her life as a result. The judge said McNichol had indecently assaulted the girl since she was five. He would show the girl and one of her friends grossly pornographic material in a private area at his Newtown secondhand shop.
Earlier this year she moved away and McNichol cruised the streets in his campervan looking for her after school. The judge said jurors had looked stunned as they heard evidence that after abducting the girl, raping her and subjecting her to other indecencies, McNichol threatened to kill her if she complained, and told her to walk home. The judge said the same girl had previously been abused by another man. McNichol claimed he was impotent but the judge said if that was true the girl would not have suffered the penetrating injuries she did. He made an order allowing a body sample to be taken from McNichol to be included in the police DNA databank.
