Background
Court of Appeal judgment here
From the Bay of Plenty Times February 7th 2007
An 18-year-old who allegedly attacked another man with a spade at a Maketu holiday park on September 6 will defend the charge. Jason Temumure Maikuku, 18, charged with wounding with intent to cause grievous bodily harm to 34-year- old Solomon Chase of Maketu, was arraigned for trial in Tauranga District Court. Mr Chase, a kiwifruit worker, suffered broken ribs, a punctured lung, skull fractures and deep cuts. Maikuku was further remanded on bail till April 17 to set a trial date.
In this case it was felt by many that the offence was committed in circumstances in which the victim's conduct substantially mitigated the offender's conduct.
