A High Court judge has sentenced a man to 10 years' imprisonment for the rape of a woman whose life, he said, had been indelibly and permanently damaged by the ordeal. The court in Auckland was told that Robert Alexander Low regretted what had happened to the woman but continued to deny any involvement in her abduction and rape in Ponsonby, Auckland, early on New Year's Day last year.
Low, 37, last month was found guilty in the High Court of abducting and raping the 41-year-old woman in the yard of All Saints' Church over a period of hours. The court had been told that Low stalked the woman, approached her from behind, pinned her arms against her body and held something that felt like a knife to her throat before he dragged her into bushes in the churchyard. Justice Paterson said the woman was bruised, grazed and scratched in the violent and long ordeal, which continued after she protested she was in pain.
"There are little if any mitigating factors to be taken into account," Justice Paterson told Low. Victim reports stated the woman was still severely traumatised by the ordeal, which had a devastating effect on her life and that of her partner's. She suffered post-traumatic stress syndrome. "She does not feel safe any more," said the judge. "She faces long-term counselling. Her life has been indelibly and permanently damaged."
