A convicted rapist with schizophrenia can be treated in prison during the seven and-a-half year term he received today for raping a Plimmerton woman. In the High Court at Wellington, Justice Neazor said a psychiatrist believed Toleafoa Laauli Leuluai would be at risk of reoffending if in the community
because there was more to Leuluai's problems than schizophrenia.The psychiatrist said Leuluai could be treated in prison and moved back to hospital if necessary.
Leuluai, 25, unemployed, of Porirua, was found guilty last month of sexually violating a 66-year-old woman by raping her and having unlawful sexual connection with her on September 17. A jury rejected Leuluai's insanity defence. Justice Neazor said the victim had been in a frail state before the rape and her and her husband's life and been badly affected afterwards. Leuluai's own family's deep regret had been movingly expressed by his sister while giving evidence at the trial, the judge said. Defence counsel Greg King said there had been some form of reconciliation between the families but he could not say everything had been fixed. For the Crown, Kate Feltham said it was accepted Leuluai had been psychotic when he raped the woman.
