Background
From Otago Daily Times story January 25th 2005
A leniency plea by the victim of an armed robbery cut months off the sentence handed down to a Hawera man yesterday. Ian William Peter Korau, aged 19, who had earlier pleaded guilty to the knife point robbery of an Oamaru dairy on November 9 last year, received a 27 month sentence and was ordered to pay reparation totalling $500. Sentencing in the Hawera District Court, Judge Louis Bidois said he had taken into account "the pretty forgiving attitude of the victim" who had suffered sleepless nights and nightmares after the incident. In a letter written to the court, the victim said "Please do not punish him too strictly - he is very young."
Crown prosecutor Justin Marinovich told the court that Korau wore a balaclava to hide his face during the robbery, and held a 10cm knife close to his victim’s chest, before fleeing with $300 from the dairy’s till. "The aggravating factor was the premeditation and the use of a weapon. A knife in the face can give a high degree of apprehension," he said. Korau’s lawyer, Patrick Mooney, said one of the most significant factors was that the robbery was totally out of character, and Korau was having difficulty coming to terms with what he had done. He said Korau had used most of the stolen money to buy a ferry ticket to travel home to Hawera, where he was arrested. Judge Bidois gave Korau an 18 month reduction on a three year nine-month sentence, for mitigating factors and the victim’s plea.
