Background
The Northern Advocate, 14th October 2009
A drunk teenager who took part in a savage attack on a motorist to get a ride back home has been sentenced to five-and-a-half years' jail. Antony Kiel, 18, unemployed of Aranga earlier pleaded guilty to two charges of aggravated robbery and charges of wounding with intent to cause grievous bodily harm, injuring with intent to injure, burglary and unlawfully interfering with a motor vehicle.
He appeared for sentencing in the Whangarei District Court yesterday. Kiel was on strict bail conditions for robbing a 14-year-old boy of a cellphone on October 20, 2008 when he committed the other offences in Dargaville. Police summary of facts stated Kiel, Matthew Tihema and a 16-year-old walked around central Dargaville trying to find a car to steal so they could get home to Waipoua Forest on November 27, 2008.
After three unsuccessful attempts to steal cars, they then decided to go to Caltex Service Station armed with a large screwdriver and a claw hammer. When freezing worker Mark Woods refused them a ride, they punched him and his passenger Lee McCullough. The victims ran inside the service station to escape but Kiel and his mates followed them and continued to punch and kick them. Tihema struck Mr Woods in the head between six and seven times with the claw hammer. Kiel and the juvenile later fled on foot while Tihema drove off in Mr Woods' car.
When arrested later, all three said they committed the offences because they wanted a ride home. Crown prosecutor Duncan Coleman said aggravating factors were the use of extreme violence and weapons by multiple attackers, and attacks to the head. Judge John McDonald sentenced Kiel to five years on the lead charge of wounding with intent to cause grievous bodily harm and six months for robbery of a cellphone. A four-year term for robbery and 12 months for other charges are concurrent to the lead charge.
