A GERALDINE man has been sent to prison for eight years for raping a teenage girl.
Joshua Riki Keen, 26, was found guilty of raping the 15-year-old and of sexual
violation by unlawful sexual connection, following a trial this year, and appeared
before Judge Raoul Neave for sentence in the Timaru District Court yesterday.
The offending happened on Guy Fawkes Day last year. Keen and the complainant were in a group of people at Kennedy Park who later went to the Talbot Forest Reserve. When the complainant left the vehicle to go to the toilet, Keen followed her. They went behind the toilet block to a bush area. He kissed her, had oral sex and intercourse with her.
Keen had always denied sexual activity took place until he spoke to the probation officer preparing his pre-sentence report. Keen told the officer intercourse had been consensual. Judge Neave noted that the outcome could have been different if Keen had made that statement at the outset.
The law meant he had no option but to consider a starting point of eight years' imprisonment for the rape as Keen had contested the charge at trial. The Crown was not seeking a longer sentence, accepting that both charges arose out of one continuing incident.
While the incident had had a significant effect on the victim, including her describing the trial process as horrible and humiliating, Keen should not be punished for that as he was entitled to go to trial, Judge Neave said. The victim had also been subjected to threats and abuse from others, but that was no reason for Keen's sentence to be increased.
None of Keen's previous convictions were relevant in considering his sentence. There were no mitigating factors and no room for manoeuvre, Judge Neave said, sentencing him to six years on the unlawful sexual connection charge and a concurrent eight-year sentence for the rape.
