"A man sentenced to two years in prison for kicking his partner so violently
that she lost an eye has been granted leave to apply for home detention.
But Michael Steven Kahotea, who has one previous conviction for assaulting
the same woman, was not habitually violent, said the sentencing judge.
The case has appalled Women's Refuge chief executive Merepeka Raukawa-Tait,
who said it was "gutless sentencing" and the judiciary was out of touch in
dealing with domestic violence offenders.
"It is a put-down to the women who do expect the sentence to reflect the
crime."
Home detention criteria specify offenders can apply if they are sentenced to
two years or less for driving, drug and property-related offences and fraud.
A Corrections Department spokesman said home detention was not for serious
violent offenders.
Kahotea, 34, was found guilty of maiming his partner, Charmaine Patea with
reckless disregard for her safety after he kicked her in the head with a
steel-capped boot.
Despite having one artificial eye and difficulties in finding work as a
result, Patea has said she still loves her
attacker and wants him back."
